Official Rules: Nugget Markets Pet Photo Contest

Eligibility:

The drawing is open only to legal residents of the State of California who are at least 18 years of age. Nugget Market, Inc. ("Nugget") associates are not eligible to win the guest prize, but immediate and extended family and friends are welcome to participate. By participating, entrants fully and unconditionally agree to and accept these Official Rules and all decisions of Nugget with respect to the contest. 

How to Enter:

You may enter the contest by submitting your photo and completing the online entry form for the “Nugget Markets Pet Photo Contest” at Nugget Market.com/pet. You must agree to the official rules for the “Nugget Markets Pet Photo Contest” by checking the boxes and submitting the form. Entries will be accepted from February 14, 2014 - February 28, 2014. ONLY ONE ENTRY PER PARTICIPANT WILL BE ELIGIBLE FOR THE “Nugget Markets Pet Photo Contest.” The photo submitted must be taken by the entrant. The photo must be  of the entrant's pet. The photo must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement; The photo must not contain brand names or trademarks; The photo must, in its entirety, be a single work of original material provided by the contestant.

Voting period:Voting: March 5, 2014 - March 19, 2014. Winners will be contacted by March 25, 2014.

Prize:

All properly completed entries will be eligible to win. The first place winner (entrant with the most votes) of the “Nugget Markets Pet Photo Contest,” will receive a $100 Nugget Markets gift card.

Condition Precedent:

Photo submitted must be an original photograph taken by the entrant. To receive the prize, the winner must receive the most votes for his/her photo on the Nugget Markets website, fully execute and deliver to Nugget Markets an (a) Affidavit of Eligibility, and (b) Publicity Release. The winner must also claim the prize in person within three (3) weeks from the date of being informed that he/she is a winner by Nugget Markets. If the prize is not claimed within the three (3) week period, the prize shall be deemed forfeited.Prizes generally should be included in taxable income for both federal and state purposes. Winners should consult their tax preparers to ensure their tax treatment is proper.The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address) and the validity of any voter, and to disqualify any entrant or voter who submits an entry or vote, respectively, that is not in accordance with these Official Rules or who tampers with the entry or voting process.

Publication of Winning Entry and Identification of Winner:

Nugget may use, publish and display any winning entry and may publicly identify and display the name, in whole or in part, of the winning entrant as permitted pursuant to the Publicity Release, though no contact or private information will be posted. The winner will not receive any prize or compensation beyond $100 Nugget Markets gift card.

General Conditions:

In the event that the operation, security or administration of the contest is impaired in any way for any reason, Nugget may, in its sole discretion, suspend, modify and/or cancel the contest. Nugget reserves the right, in its sole discretion, to disqualify any entrant Nugget finds to have tampered with the entry process or to have acted in violation of these Official Rules. Nugget reserves the right to disqualify any entry that we deem offensive. Nugget’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of the Official Rules.

Nugget Market, Inc. assumes no responsibility for any of the following in connection with the contest: any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to contest entries or votes; or alteration of entries or votes. Nugget Market, Inc. is further not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any entry or vote to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, fraud by any entrant, entrant or vote, or any combination thereof, including without limitation any injury or damage to entrants', voters' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials in this contest.

Privacy

By submitting a photograph to our contest, your content is available to the public.

By entering, entrants agree that personal data, including without limitation name and address, may be processed, shared, and otherwise used for the purposes and within the context of the contest and any other purposes outlined in these Official Rules.

Sponsor Released from Liability:

By participating in this contest, entrants agree to waive and release and hold harmless Nugget, and its owners, directors, officers, employees and agents from and against any claim or cause of action arising out of participation in this drawing, including, but not limited to: a) unauthorized human intervention in the drawing; b) technical errors; c) printing or typographical errors; d) errors in the administration of the drawing; and e) late or lost entries.
